  1. NATURE OF PERSONAL DATA PROCESSED

Atesy and the other subjects, who carry out the assigned tasks on its behalf or in favor of it, will process data concerning common personal data which are, for example: personal data (name, surname, address, telephone number, e-mail and other contact details).

In the absence of such personal data, the company will not be able to perform the operations and manage the relationships that require the processing of your personal data.

  1. PURPOSE OF THE PROCESSING OF PERSONAL DATA AND LEGAL BASIS

The collection and processing of personal data, including particular data as identified above, will be carried out:

  • Without the express consent of the interested party (art.24 letter a), b), c) privacy code and art.6 letter b), e) GDPR), for the following purposes:
    • conclude contracts for Atesy’s services;
    • to reply to your inquiries;
    • fulfil pre-contractual, contractual and tax obligations arising from existing relations with you;
    • fulfil obligations under law, regulation, EU legislation or under an order of the Authority (ex: anti-money laundering);
    • exercise Atesy’s rights, such as the right of defense in court.

Your data is collected to enable Atesy to provide its services, as well as for the following purposes: display of content from external platforms, statistics, address management and email message sending, registration and authentication, traffic optimization and distribution and contacting the user, direct marketing activities (only when the conditions provided for by European and national legislation to carry out this activity have been met without the prior consent of the person concerned).

  1. TREATMENT MODALITIES

Your personal data will be processed according to the principles of correctness, lawfulness, transparency and protection of your privacy and your rights.

The processing of data for the above purposes will be carried out both automatically, on electronic or magnetic media, and non-automatically, on paper, in compliance with the rules of confidentiality and security provided for by law, consequent regulations and internal provisions.

Atesy takes appropriate security measures to prevent unauthorized access, disclosure, modification or destruction of personal data. The processing is carried out via computer and/or telematic tools, with organizational methods and logics strictly related to the purposes indicated. In addition to Atesy, in some cases, other parties involved in the organization of this website or external parties (such as third party technical service providers, postal carriers, hosting providers, computer companies, communication agencies) may have access to the data also appointed, if necessary, as data processors by Atesy.

Your data is processed at Atesy’s operational headquarters and in any other place where the parties involved in the processing are located. For more information, you can contact Atesy directly.

Your personal data may be transferred to a country other than the one in which you are located. For further information on the place of processing, please refer to the section on details of personal data processing.

You have the right to obtain information about the legal basis for transferring data outside the European Union or to an international organisation under public international law or formed by two or more countries, such as the UN, as well as about the security measures taken by Atesy to protect your data.

  1. PLACE OF TREATMENT

The data will be processed and stored at the registered and operational headquarters located in Via Claudio Monteverdi, 8 – 20831 Seregno (MB). The data may also be processed on behalf of Atesy by professionals and/or companies appointed to carry out technical, development, management and administrative-accounting activities.

  1. DATA COMMUNICATION

Without prejudice to the communications made in compliance with legal and contractual obligations, all data collected and processed may be communicated within the EU exclusively for the purposes specified above a:

  • entities providing services for the management of the owner’s information system and communication networks, including electronic mail and website management;
  • studies or companies in the context of assistance and consulting relationships;
  • authorities competent to fulfil legal obligations and/or provisions of public bodies, upon request;
  • in case of administrative and accounting purposes, the data may possibly be transmitted to commercial information companies for the evaluation of solvency and payment habits and/or to subjects for debt collection purposes;
  • the subjects belonging to the above categories perform the function of data controller or sub-processor or operate in total autonomy as separate data controllers.
  1. RIGHTS OF THE DATA SUBJECT

Regarding personal data you may exercise, under the conditions and within the limits provided for by the EU Regulation and the Privacy Code, the rights set out in Articles 15 to 22 and Article 34 of the EU Regulation. In particular, you have the right to obtain from Atesy access, rectification, integration or deletion of your personal data, limitation to processing and portability of personal data; you also have the right to object to the processing of your personal data and the right to lodge a complaint with the authority, the Guarantor (see annex “Rights of the data subject”). The rights provided for in Articles 15 to 22 of the EU Regulation may be limited in the cases provided for in Article 2 – undecies of the Privacy Code.

You may exercise the above rights at any time by sending a notice to the contacts indicated below.

We also inform you that pursuant to art.140 bis of the Privacy Code, you may lodge a complaint with the Guarantor or appeal before the judicial authorities.

Atesy, also through the designated structures, will take charge of your request and provide you, without undue delay and in any case within one month of receiving it, with information on the action taken about your request.

  1. DISCLOSURE OF DATA TO THIRD PARTIES

We may need to disclose your personal information to other affiliated companies or external service providers acting solely on our behalf.

We ensure that external service providers use your personal data only in accordance with our instructions and this privacy policy.

Atesy guarantees that these suppliers have the legal requirements for data processing.

Your personal data will always be treated confidentially and will not be disclosed to third parties who are not acting on our behalf, unless you have consented to its disclosure in writing or electronically or unless we are legally authorized or obliged to do so.

The data collected in the contact form are communicated to the company responsible for processing the request. Therefore, the processing of personal data may also take place in countries outside the EU/EEA, insofar as this is necessary to provide a response.

  1. LEGAL BASIS FOR THE TREATMENT

Atesy will process your personal data if one of the following conditions is met:

  • has given his consent for one or more specific purposes;
  • the processing is necessary for the performance of a contract and/or pre-contractual measures;
  • treatment is necessary to fulfil a legal obligation to which Atesy is subject
  • the treatment is necessary for the performance of a task in the public interest or for the exercise of public authority vested in Atesy;
  • processing is necessary to pursue the legitimate interest of Atesy or third parties.

However, it is always possible to ask Atesy to clarify the concrete legal basis of each treatment and to specify whether the treatment is based on law, provided for in a contract or necessary to conclude a contract.

  1. DURATION OF DATA STORAGE

The data are processed and stored for the time required by the purposes for which they were collected.

Therefore: data collected for purposes related to the execution of a contract will be retained until the execution of such contract is completed and all legal and fiscal effects related to such processing have been exhausted; personal data collected for purposes related to Atesy’s legitimate interest will be retained until that interest is satisfied. When the processing is based on your consent, Atesy may revoke your personal data for a longer period until your consent is revoked. In addition, Atesy may be required to retain personal data for a longer period in accordance with a legal obligation or by order of an authority. At the end of the retention period the personal data will be deleted. Therefore, at the end of this period the right of access, deletion, rectification and portability of the data can no longer be exercised.
